    Welcome to Pekto. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our services.

    1. Acceptance of Terms

    By creating an account, accessing, or using Pekto's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

    We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our platform. Your continued use of Pekto after such modifications constitutes your acceptance of the updated Terms.

    2. Description of Service

    Pekto provides an AI-powered platform that transforms written content (blogs, articles, reports, presentations, and other text) into professional infographics, presentations, and visual stories. Our services include:

    • AI-powered content analysis and transformation
    • Access to professional design templates
    • Drag-and-drop visual editor
    • Export and sharing capabilities
    • Cloud storage for your projects
    • Community template library

    3. User Accounts and Responsibilities

    Account Creation: To use Pekto, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

    Account Security: You must notify us immediately of any unauthorized use of your account or any other security breach. Pekto will not be liable for any loss or damage arising from your failure to protect your account information.

    Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that we deem harmful to our platform or other users.

    4. Content Ownership and Licensing

    Your Content: You retain all ownership rights to the content you upload to Pekto. By using our services, you grant Pekto a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving our services.

    Generated Content: The infographics and visual content generated using Pekto belong to you. You may use, modify, and distribute them as you see fit, subject to any applicable third-party licenses for templates or assets used.

    Community Templates: If you choose to publish templates to our community library, you grant other users a license to use those templates in their own projects. You represent that you have the right to share such content.

    5. Prohibited Uses

    You agree not to use Pekto for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include, but are not limited to:

    • Uploading content that infringes on intellectual property rights
    • Distributing malware, viruses, or harmful code
    • Attempting to gain unauthorized access to our systems
    • Using our services to create misleading, defamatory, or illegal content
    • Scraping or automated data collection without permission
    • Reselling or redistributing our services without authorization
    • Violating any applicable laws or regulations

    6. Payment and Subscriptions

    Pricing: Pekto offers both free and paid subscription plans. Pricing for paid plans is displayed on our website and may be subject to change with notice.

    Billing: Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). You authorize us to charge your payment method for all fees incurred.

    Cancellation: You may cancel your subscription at any time by contacting us at michael@trypekto.com. Our founder typically responds within minutes. Cancellations take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

    Free Trial: We may offer free trials for paid plans. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

    7. Intellectual Property

    All content, features, and functionality of Pekto, including but not limited to software, text, graphics, logos, and templates, are owned by Pekto and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without our express written permission.

    8. Disclaimers and Limitations of Liability

    Service "As Is": Pekto is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure.

    Limitation of Liability: To the maximum extent permitted by law, Pekto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our services.

    Maximum Liability: Our total liability to you for any claims arising from your use of Pekto shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

    9. Indemnification

    You agree to indemnify, defend, and hold harmless Pekto, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of another party.

    10. Termination

    We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use Pekto will immediately cease.

    You may terminate your account at any time by contacting us at michael@trypekto.com. Upon termination, you may lose access to your content and projects stored on our platform.

    11. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pekto operates, without regard to its conflict of law provisions.

    Any disputes arising out of or related to these Terms or your use of Pekto shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.
